Who We Are

This website, russellfirestone.com (the “Site”), is owned and operated by Firestone Real Estate LLC, a Delaware limited liability company (“we,” “us,” or “our”). Russell Firestone is a licensed real estate agent affiliated with TTR Sotheby's International Realty, 1206 30th St NW, Washington DC 20007.

Acceptance of These Terms

Please read these Terms of Use (the “Terms”) carefully before using the Site. These Terms govern your access to and use of the Site and apply to all visitors. By accessing or using the Site, you agree to these Terms. IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT USE THIS SITE.

We reserve the right, in our sole discretion, to modify, alter, or otherwise update these Terms at any time. Modifications are effective immediately upon posting. By using the Site after modifications are posted, you agree to be bound by the revised Terms.

Privacy

Information we collect about you through the Site is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Accounts

Certain features of the Site — such as saving properties and creating listing alerts — require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating an account and to notify us promptly of any unauthorized use. We may suspend or terminate accounts, and refuse or restrict access to the Site, at our discretion, including for violation of these Terms.

Intellectual Property

Content on the Site, including text, images, illustrations, audio, and video (the “Content”), is protected by copyright, trademark, and other intellectual property laws, and is owned or controlled by Firestone Real Estate LLC or by third-party content providers and licensors. The Sotheby's International Realty name and marks are service marks licensed to Sotheby's International Realty Affiliates LLC and are used with permission; they are not owned by us.

Real estate listing content is provided by IDX Broker and participating brokers in Bright MLS and is made available solely for your personal, non-commercial use. You may print or save a copy of Content for your personal, non-commercial use, but you may not otherwise copy, reproduce, republish, upload, post, transmit, distribute, or exploit Content in any way — including by email or other electronic means — for commercial use without prior written consent from us or the applicable content owner. You may not frame or incorporate any part of the Site into another website, or use any trademarks or logos appearing on the Site, without prior written consent of the owner.

Prohibited Activities

You agree not to use the Site, or permit others to use the Site, to:

• take any action that imposes an unreasonable or disproportionately large load on the Site's infrastructure, including spam or other unsolicited mass messaging;
• share your account credentials with unauthorized third parties or use another person's credentials without authorization;
• decipher, decompile, disassemble, or reverse engineer any software or code comprising any part of the Site;
• upload, post, or transmit any content you do not have the right to transmit, or any material that is threatening, libelous, defamatory, obscene, or otherwise unlawful;
• violate any applicable local, state, national, or international law or regulation; or
• use any robot, spider, scraper, or other automated device or manual process to search, monitor, or copy the Site or its Content — including listing data — without our prior written permission (ordinary web browsers excepted).

If you violate any of these Terms, your permission to use the Site terminates immediately without the necessity of any notice.

Listing Data; No Professional Advice

Listing information on the Site is deemed reliable but is not guaranteed and should be independently verified. Property information, market commentary, valuations, and other Content are provided for your convenience and general information only, and do not constitute legal, financial, tax, or investment advice. Use of the Site does not create an agency, brokerage, or fiduciary relationship between you and Firestone Real Estate LLC, Russell Firestone, or TTR Sotheby's International Realty. An agency relationship is formed only through a separate written agreement.

Links to Other Websites

The Site may contain links to third-party websites (“Linked Sites”), provided for your convenience only. Linked Sites are not under our control, we are not responsible for their content, and a link does not imply our endorsement. Your use of Linked Sites is governed by their own terms and policies, and you access them at your own risk. Indemnification

You agree to indemnify, defend, and hold harmless Firestone Real Estate LLC, its content providers, hosting and service providers, and its and their members, officers, employees, affiliates, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation by you of these Terms or misuse of the Site.

Third-Party Rights

These Terms are for the benefit of Firestone Real Estate LLC and the parties identified in the two preceding sections. Each of these individuals or entities has the right to assert and enforce these Terms directly against you on its own behalf.

Jurisdictional Issues

The Site is operated from the United States. We make no representation that Content on the Site is appropriate or available for use in other locations. Those who access the Site from other locations do so on their own initiative and are responsible for compliance with local laws, to the extent applicable. You may not use or export materials from the Site in violation of U.S. export laws and regulations.

Resolving Disputes

If a dispute arises between you and Firestone Real Estate LLC, we want to resolve it efficiently. Most concerns can be resolved quickly by contacting us at rfirestone@ttrsir.com or 202.271.1701. If a dispute cannot be resolved informally, the following provisions describe how it will be resolved.

Agreement to Arbitrate Disputes

PLEASE READ THIS SECTION CAREFULLY — IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS. IT CONTAINS PROCEDURES FOR MANDATORY BINDING ARBITRATION AND A CLASS ACTION WAIVER.

We both agree to arbitrate. If you are a U.S. resident, you and Firestone Real Estate LLC agree to resolve any claims relating to these Terms or the Site through final and binding arbitration, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Site or intellectual property infringement without first engaging in arbitration or the informal dispute-resolution process described above.

What is arbitration. Arbitration is more informal than a lawsuit in court and seeks to resolve disputes more quickly. Instead of a judge or jury, the case is decided by a neutral arbitrator who has the power to award the same damages and relief that a court can. If any provision of this arbitration agreement is found unenforceable, that provision shall be severed and the remaining arbitration terms shall be enforced.

Arbitration procedures. The Federal Arbitration Act governs the interpretation and enforcement of this dispute-resolution provision. Arbitration shall be initiated through JAMS, and any dispute, controversy, or claim arising out of or relating to these Terms shall be referred to and finally determined by arbitration in accordance with the JAMS Streamlined Arbitration Rules and Procedures. If there is a conflict between the JAMS Rules and this agreement to arbitrate, this agreement governs. The JAMS Rules and instructions for initiating arbitration are available at jamsadr.com or 1-800-352-5267. To initiate arbitration, a party must submit a written Demand for Arbitration to JAMS describing the claim and damages sought, pay the applicable filing fee, and send a copy of the demand to the other party. Payment of all filing, administration, and arbitrator fees is governed by the JAMS Rules. Arbitration under this agreement shall be held in the United States county where you live or work, in Washington, DC, or in any other location we mutually agree to.

Authority of the arbitrator. The arbitrator will decide the rights and liabilities, if any, of you and Firestone Real Estate LLC. The dispute will not be consolidated with any other matters or joined with any other cases or parties. The arbitrator has the authority to grant dispositive motions, award monetary damages, and grant any non-monetary remedy or relief available to an individual under applicable law, the JAMS Rules, and these Terms, and will issue a written award and statement of decision describing the essential findings and conclusions on which the award is based. The arbitrator's award is final and binding on you and Firestone Real Estate LLC.

No class actions. You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not allowed.

Waiver of jury trial. THE PARTIES WAIVE THEIR CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR JURY, instead electing that all claims and disputes be resolved by arbitration. In the event any litigation should arise between you and Firestone Real Estate LLC in any state or federal court in a suit to vacate or enforce an arbitration award or otherwise, YOU AND FIRESTONE REAL ESTATE LLC WAIVE ALL RIGHTS TO A JURY TRIAL, instead electing that the dispute be resolved by a judge. You acknowledge that you have been advised that you may consult with an attorney in deciding to accept this agreement to arbitrate.

Opt-out. You can decline this agreement to arbitrate by emailing rfirestone@ttrsir.com within 30 days of the date you first accept these Terms by using the Site, providing: (1) your name; (2) the URL of these Terms; (3) your address; (4) your phone number; and (5) a clear statement that you wish to opt out of this arbitration provision.

Choice of Law and Forum

In any circumstance where the agreement to arbitrate permits the parties to litigate in court, these Terms shall be governed by and construed in accordance with the laws of the State of Delaware, excluding its conflict of law rules, and you consent and agree to submit to the exclusive jurisdiction and venue of the state and federal courts located in the State of Delaware.

If any inconsistencies exist between these Terms and any future published terms of use, the last published Terms of Use shall prevail.
